I’d contact a personal injury lawyer. Big payout here. Way more so than the car.
That's standard operations with insurance companies. There's no way they will even start processing the claim without a police report, even tho the offending party admitted fault (which is great for you). Unfortunately things just don't run that quickly.State Farm. They are returning calls but not accepting liability until the police report is accessible and that might take "two or more weeks". Which is BS. The driver admitted fault and the driver of the truck I hit stated several times that I had stopped prior to hitting him. I believe the kid may have lawyered up, and I don't necessarily blame him.
I've been through the motorcycle safety course, advanced rider course, and EVOC. I drive with the expectation that everyone is out to kill me. I was stopped over a car length from the vehicle in front of me with my foot pushing the brake pedal to the floor (I was expecting the hit). Still made little difference.Car is a goner. Some years ago when I took my driving lessons I had an amazing instructor. He wanted me to stop behind the other vehicle that I could see the tires of that car. His explanation was, if car rearends me it would be that driver's fault, if car rearends me and my car hits car in front of me that would be my fault. That what your insurance thinks as well.

This is very true, the forces involved are shocking to say the least and not what most people would expect.I consulted with a local Personal Injury Lawyer. After a brief discussion with my wife, I decided to hire him. I'm not looking to "get paid" so much as I just need someone who's skilled in personal injuries/insurance companies to handle it so I can focus on my health.

The TBI specialist that I was referred to said that studies have proven that a frame-to-frame hit can propel the impacted vehicle 2.5 times or more than the speed of the impacting vehicle.

I took defensive driving coarse and refresher coarse during my driving years. The biggest mistake IS to hold break with your foot. The best is to put car in Neutral gear as it helps to avoid or minimise knee injuries, the problem with that that accidents happen really fast and usually inexperienced drivers don't have time to react but you sew it coming. If it is freeway you should keep one car length per every10 miles of speed. Just saying.

How is holding the brake a mistake? Are you advocating that it's better to let your vehicle launch into the car in front of you with zero resistance? That makes no sense. Also, how does putting it in neutral make any difference in getting rear ended? The comps in the area from range about $9,200 - $11,900, with the average around 10K. NADA is $10,500 on a clean 2011 Xterra so I am going to push for that.Insurance adjuster here. When searching for comps make sure it is the exact same trim level and year model. Mileage needs to be as close as possible. The comps need to be in the area too. I get people all the time wanting me to compare a 4WD top trim level to their 2wd base trim. Also if there are several examples similar and going for what insurance offered, a few more expensive ones won't trump. Meaning for example, I had to total an Accord. We offered him 21K. There were about a dozen going between 19K and 22k. He found 2 going for 24K. We didn't change since there several going in the range we offered. Also a lot of people think we owe for the next car. We owe for the car that was totaled. So if yours had a trashed interior, hail damage, missing trim pieces etc, yeah the offer is going to be less than a similar one sitting on a dealer lot but without damage or missing pieces.

Hard to imagine that Xterra isn't a total loss even without frame damage but good to see you were not injured any worse than what you were. Any accident where a car is totaled and you live to tell about it is not a bad outcome in the grand scheme of things. Wishing you a speedy recovery and favorable outcome with your insurance company.
Thanks, MartinX. Sounds like a terrible hit that you took. I was a firefighter for a few years in the early '00s. Just in that short period of time, I cannot count the extractions that I was part of. My daughter and I are very blessed to walk away without being severely injured. Had we been in her Civic, or my wife's Maxima, things could have been different.Sucks to see you lose the X. Nice replacement Fronty though!

I was t-boned by a red light runner in an old Ford pickup 20 years or so ago. Seriously crushed the driver side of our car and pushed us 20 feet. I had to be pulled out the back through the pass side rear door. Truck barely looked hit. Same with that Camero in your wreck. Blows my mind that the front end isn’t folded in at all… Crazy compared to your damage.
We got lucky with girlfriend’s insurance, as the Ford driver was uninsured. All medical bills paid, etc.
(Yeah, I was driving her car…….)
Take the time you need to recover. My shoulder was (is) never the same after that one.
